The first paragraph of Article 100 TFEU provides that the Transport Title shall apply to transport by rail, road and inland waterway. The second paragraph grants the European Parliament and Council the power to lay down appropriate provisions within the scope of the Transport Title on sea and air transport. The reason for the transport mode split between paragraphs 1 and 2 lies in the historical evolution of Article 100 TFEU.",
