Abstract
In a planned reform of the national disability service legislation the elderly above the age of 75 year seems, according to published governmental documents, to loose their right to disability services based on the Diasbility Service Act (380/1987). In the article this concept for the reform will be criticized as unconstitutional and creating a law based discrimination. The article will argue that articles 22 and 106 of the Constitution which offer possibilities to challange the implementation of such an legislation i national courts of law.
