The General Principle of Equality as a Value Commitment in EU Law: Scope, Limits, and Challenges

Abstract

This chapter examines how the general principle of equality gives expression to equality as one of the core values of European integration. The chapter will first describe the origins and the operation of equality as a general principle of EU law. It will then consider how the rationale of equality has diversified through the constitutionalisation of EU law and the development of EU fundamental and citizenship rights. Lastly, analysis of distributive and democratic dimensions of equality will map the caveats of equality as a substantive principle in the EU legal order. These findings will illustrate both the potential and the limits of general principles in manifesting the values of European integration.
