Queering Wills – Inheritance Arrangements in Sexually Marginalised Groups

Abstrakti

I will discuss the concept of inheritance institution, the history of queer inheritance, the changing legal landscape around LGBTQI+ issues in Europe and beyond, and the significance of inheritance for social justice and widening economic gaps in society at the era of finance capitalism, political populism, ’homonationalism’ and neo-conservative politics/polities that are pushing sexuality off-stage and returning care-giving, solidarity and other everyday support from the state and queer communities to a more private sphere, to families, in (gay) marriages and for women (in general, daughters, and in particular, lesbian parents in Rainbow families).
I will also explain the impact of different legal cultures and cultural imaginaries around wills in different European countries (i.e. legal share vs. testamentary freedom). I will also ask what kinship has to do with succession law, and what is meant by the concept of ’inheritance family’ in different national contexts.
Finally, I will open up the question if will-writing and inheritance system is ‘heteronormative’, and if it belongs only to the bourgeoisie; and whether or why we need to go beyond these implications in the contemporary legal and political era.

Dr. Antu Sorainen, PhD, is Docent in Gender Studies, working as Principal Investigator at the University of Helsinki.
She was the Director of the research team “CoreKin – Contrasting and Re-Imagining Margins of Kinship” (Academy of Finland, 2016-2020). Her current research project focuses o Protolesbian Personal Histories and Nationalist Sentiment in the 1920-30s Finland (The Cultural Foundation of Finland, 2019-2024).
She has conducted empirical studies in queer sexualities, especially in the legal field. She is the co-author of a book on the conceptual history of “Sittlichkeit”, and is publishing on queer kinship and inheritance practices.
Sorainen was an Academy Fellow at the Academy of Finland and the PI of the research project titled “Wills and Inheritance Practices in Sexually Marginalised Groups” (2014-2019).
