Sammanfattning

Information is the most handled good in digital markets. Where large digital platforms, such as Google or Facebook, act as information intermediaries, this may lead to a number of issues in relation to how this information is handled. Digital platforms can bias the way information is presented (e.g. through algorithm design), refuse access to it (by denying access to essential business information) or gather internet users’ private information without their permission. Could any of the aforementioned behaviours be considered abuses of dominance?
This chapter aims to answer the question of whether new categories of information-based abuses of dominance should be created to reflect the environment of digital markets. Moreover, as information in digital markets can be seen not only as a ‘commodity’ but also as a type of ‘commons’, competition law, in dealing with information-based abuses, could also take into account non-competition law goals, such as fairness or privacy considerations, as welfare standards. Who should deal with these kinds of information-based abuses? Should they be handled by national competition authorities/the EU Commission, or should separate digital agencies be created solely to regulate the behaviour of digital platforms?
